In the following you will find the general terms and conditions (GTC) of Interactive GEM Ltd and Interactive GEM Australia Pty Ltd (in following referred as Interactive GEM). Interactive GEM takes data protection very seriously and treats users’ personal data confidentially and in accordance with statutory provisions. The personal data are treated confidentially and collected, processed and used in compliance with the statutory data protection regulations. The aim of collecting personal data is the ongoing optimization of our website, the communication options offered, the online offers and the design of our products and services.

Sofern Nutzer über die angebotenen Kontaktmöglichkeiten mit STINA als Betreiber der Webseite oder als Anbieter von Online-Angeboten und Dienstleistungen in Verbindung treten, werden die angegebenen Daten gespeichert, damit sie zur weiteren Bearbeitung und Beantwortung der konkreten Anfrage genutzt werden können. Ohne Ihre Zustimmung werden diese Daten nicht an Dritte weitergegeben. Hinsichtlich der Archivierung von Geschäftsdokumenten halten wir uns an die gesetzlichen Aufbewahrungspflichten. Die Archivierungspflicht umfasst die folgenden Dokumente: Geschäftsdokumente wie Bücher, Belege und Buchhaltungsunterlagen, Inventare, Jahresabschlüsse, Geschäftsberichte, die Eröffnungsbilanz sowie die zu deren Verständnis notwendigen Arbeitsanweisungen und sonstigen organisatorischen Unterlagen, die erhaltenen Handels- oder Geschäftsbriefe, Reproduktionen der versandten Handels- oder Geschäftsbriefe, sonstige Unterlagen, soweit sie für die Besteuerung (Umsatzsteuer) von Bedeutung sind – auch solche, die sich nur auf Rechnungen beziehen. Aus der Sicht des Gesetzgebers sind die aufgeführten Dokumente nicht nur in Papierform, sondern auch in Form von E-Mails und anderen elektronischen Kommunikationsmöglichkeiten archivierungspflichtig. Dies gilt auch für alle Briefe, die eine Transaktion vorbereiten, durchführen, abschließen oder annullieren. Beispiele sind Rechnungen, Bestellungen, Auftragsbestätigungen, Zahlungsbelege und Verträge. Die Kommunikationskanäle werden von STINA so weit wie möglich mit vertretbarem Aufwand und technischen Hilfsmitteln kategorisiert und auf der Ebene der Geschäftsjahre archiviert. Die automatisch identifizierbaren Geschäftskommunikationsinformationen werden mindestens bis zum Ablauf der Steuerrückerhaltungsfrist (7 Jahre) und höchstens bis zum Ende der Produkthaftung (10 Jahre) gespeichert. Generell ist zu beachten, dass das Löschen von archivierten Daten auf ganzen Geschäftsjahren basiert, was die genaue Aufbewahrungsfrist leicht verschieben kann. Aufgrund von Backup- und Archivierungsprozessen können die gespeicherten Daten noch weitere 12 Monate in unseren Systemen verbleiben.

In the case of external partners and subcontractors used by Interactive GEM, the information relevant to the fulfillment of the contract is made available to external partners. The cooperation of Interactive GEM with external partners is contractually regulated, which is why they are also obliged to comply with this data protection declaration. The data processing takes place on the basis of the legal provisions of § 96 Abs. 3 TKG and § 6 Abs. 1 lit a (consent) and / or lit b (necessary for the fulfillment of the contract) of the GDPR. After canceling the purchase process, the data stored by us will be deleted. In the event of a contract being concluded, all data from the contractual relationship will be stored at least until the end of the tax retention period (7 years) and until the expiry of product liability (10 years). In the case of sales transactions, data such as name, address, purchased goods and date of purchase are usually stored until the end of product liability (10 years). Due to backup and archiving processes, the stored data can remain in our systems for a further 12 months in both cases.

The log files and protocols are kept for a period of 6 months and then deleted. Due to backup and archiving processes, the log files and protocols can remain in our systems for a further 12 months, resulting in a maximum retention period of 18 months. In principle, the log files and protocols are not passed on to third parties. An exception is the legally required release of log files and protocols at the request of state investigative authorities. If data has to be saved for reasons of proof, it cannot be deleted until the incident has been finally clarified. Due to technical circumstances, a separate treatment of certain user data cannot be guaranteed, since log files, protocols and backups usually encompass entire systems.
User rights
The users of the Interactive GEM websites and other online offers have the right to request information about the applicant’s data stored by Interactive GEM free of charge. Users also have the right to information, correction, deletion, restriction, data transfer, revocation and objection.
